1. INTERPRETATION In these Terms and Conditions the following words have the following meanings: “the Company” means A-Z Embroidery Limited whose registered office is 13 Ridgewood Drive, Burton-upon-Stather, Scunthorpe, North Lincolnshire, United Kingdom, DN15 9YE Tel 01724 721073 (Mon - Fri 9am-5pm) “Contract” means the agreements between the Company and the Purchaser for the purchase of the Goods and incorporating these terms and conditions and any special conditions detailed in the Order or on the website. “Goods” means the goods to be supplied or procured by the Company and purchased by the Purchaser on the terms of the Contract. “Order” means the purchase order containing details relating to the Goods and Contract. “the Purchaser” means the person, firm, company or other organisation purchasing the Goods from the Company. 2. GENERAL 2.1 The Company do business upon and subject to these general conditions which will be deemed to be incorporated into all Contracts between the Company and the Purchasers to the exclusion of any other terms and conditions of the Purchasers. 2.2 A quotation shall only constitute an invitation to treat. All Orders are subject to acceptance by the Company, the Purchasers acceptance of delivery of said acknowledgement of Orders shall be deemed to include acceptance of these general conditions 2.3 Telephone Orders must be confirmed in writing or email. No responsibility will be accepted if this is not done. 3. PRICES All Our Prices listed on this website are listed clearly in GBPound Sterling. Prices are not currently subject to VAT 4. DELIVERY United Kingdom Mainland Delivery normally takes 7 to 10 business days (from date of despatch). Orders received after 5pm GMT will be classed as Next Day. All Orders will be sent via a Recorded Delivery Service (Signature Required). We are unable to give you an Exact Delivery Date. However, we will notify you of the tracker number supplied to us when we send your goods to you so that you are able to track your order. You can contact us via our Customer Service Line or email quoting your order number for an estimated delivery time. Failed deliveries are usually taken to your Local Sorting Office and we are not responsible for their collection. If a Parcel is returned to us due to a Failed Delivery you are responsible for any subsequent reasonable postal charges to have your parcel re-distributed. All delivery times are within the control of the outside carrier and therefore are not guaranteed by A-Z Embroidery Limited. We do not currently offer overnight shipping. 5.1 NOTICE OF NON-DELIVERY, SHORTAGE OR DAMAGED GOODS The Purchaser shall inspect all Goods immediately upon delivery and shall within three days from delivery notify the Company of any matter or thing by reason of which they may allege that the Goods are not in accordance with the Contract. If the Purchaser shall fail to give such notice within such period it shall conclusively be determined that the Goods are as to quality, number, weight, volume and in all respects in accordance with the contract and that the Purchasers have accepted them. The Purchasers shall have no right to reject the goods, but shall be bound to pay for the same accordingly. Goods damaged in transit should not be accepted from the carrier and no credit will be given for or replacements made of Goods accepted from the carrier in a damaged condition. Non delivery by any carrier must be notified to the Company via email within 14 days. Goods are only returnable with our expressed agreement. Goods will not be accepted back without prior agreement. 5.2 RETURNING PRODUCTS Non-faulty Goods. We cannot accept returns of Non-Faulty goods. All our products have been personalised or customised specifically for your requirements. Faulty Goods. If your goods are faulty please contact us within 3 days of accepting delivery, prior to returning any product. We may allocate you with a Returns Code which should be included with the package to improve processing of your return. We may also advise you how to send the item back to us. Occasionally items may have to be picked up by a courier service. On inspection of the returned item(s) we will advise you of our decision. All costs will be refunded if the item(s) are deemed to be faulty. 6. PRODUCT SPECIFICATION/SAFETY Due to differing monitor/screen settings exact fabric shades may vary from the displayed images. All product dimensions are approximate and are for general guidance only. All goods are New and are packaged according to BS Safety Guidelines. Please dispose of all packaging materials safely and carefully. Please recycle where possible. All materials used conform to EN71 Toy Safety Standards. Bears such as Bracken Bear, and Honey purchased from A-Z Embroidery Limited are not suitable for children under the age of 36 months due to choking hazard. 7. PERSONALISATION Due to the Customised/Personalised Nature of Our Products sold on our website, cancellations will not be honoured once an order has entered into production. All orders are to be fully paid for before Production commences. We are not responsible for any misspellings of Names, requested Personalisation etc. submitted by you. We will however confirm 'obvious mistakes' with the buyer prior to Production. A-Z Embroidery Limited reserves the right to refuse any order placed by you and to contact you for alternative text as it deems appropriate if any text appears to A-Z Embroidery Limited to be offensive or unacceptable or detrimental to A-Z Embroidery Limited reputation or that of its business partners. 8. COMMUNICATION You agree that e-mail will be used as the standard means of communication. If your order is accepted, we will send you an e-mail confirming this. This confirmation e-mail will contain all relevant statutory information concerning your Order. A-Z Embroidery Limited does not store any credit card information, nor will we pass any of your personal information to any third party. We may at anytime contact you via email to clarify and/or verify particular aspects of your order. We will not send you un-solicited emails(SPAM). You undertake that all details which you provide to us for the purpose of ordering goods are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the order. Your statutory rights are not affected but otherwise all purchases are non-exchangeable, non-refundable and non-transferable. 9. LIABILITY A-Z Embroidery Limited attempts to ensure that the information available on the website at any one time is true and accurate but cannot guarantee that it will be error-free. A-Z Embroidery Limited does not make any warranty that the website is free from infection by viruses, trojans, worms or anything else that may have destructive properties. A-Z Embroidery Limited does not accept liability for any errors and omissions and reserves the right to change information, specifications and descriptions of listed goods, products and services. A-Z Embroidery Limited will do its best to correct errors and omissions as quickly as practicable after being notified of them. 10. LAW Every purchase you make shall be deemed performed in England. These Terms and Conditions shall be governed, construed and interpreted in accordance with the laws of England and Wales. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998 & subsequent revisions thereof). We collect information about you for three reasons: to process your order (including payment authorisation), to provide you with the best possible service and to assist in developing the sites content. We will not e-mail you in the future unless you have given us your consent (unless to confirm orders). 4. DELIVERY

United Kingdom Mainland Delivery normally takes 7 to 10 business days (from date of despatch). Orders received after 5pm GMT will be classed as Next Day.
